1. Acceptance of Terms
By accessing or using Wouchh ("the Service"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Data Deletion Policy. You also agree to comply with the platform policies of any social media services you connect through the Service, including:
- TikTok Terms of Service

- TikTok Privacy Policy
- Meta Platform Terms
- Meta Developer Platform Terms
If you do not agree to these Terms, you must not use the Service. If you are using the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.
2. Description of the Service
Wouchh is a third-party business automation tool operated by Wouchh. With your explicit permission granted via OAuth authorization, it uses official platform APIs to help you:
- View and manage your business profile and account metrics
- Monitor brand mentions and tags across platforms
- View and reply to comments on your owned content
- Send and receive direct messages within platform rules
- Publish and schedule content
- View engagement analytics and creator insights
The Service currently supports TikTok Business accounts, with Facebook and Instagram integrations planned for future release.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Have authority to manage the business accounts and pages you connect
- Have a valid business account on at least one supported platform
- Not be located in a jurisdiction where use of the Service is prohibited
4. Your Responsibilities
- You must comply with each platform's community standards, advertising policies, and developer terms at all times.
- You must not use the Service to send spam, harass users, disseminate harmful content, or violate any applicable laws or regulations.
- You are solely responsible for all content published through the Service on your behalf.
- You must not initiate unsolicited messages in violation of platform messaging policies. In particular, TikTok prohibits messaging users who have not messaged your business first.
- You must not attempt to circumvent any platform restrictions, rate limits, or security measures through the Service.
- You must keep your account credentials secure and notify us immediately of any unauthorized access.
5. Access Tokens and Authorization
When you connect a social media account, you grant Wouchh permission to store and use access tokens solely to deliver the features you have configured. Tokens are:
- Encrypted at rest using AES-256
- Transmitted only over TLS 1.2+
- Decrypted in-memory only to execute authorized API calls
- Never shared with third parties beyond the respective platform provider
You may revoke access at any time through your platform settings:
- TikTok: Settings → Manage account → Third-party apps → Remove Wouchh
- Facebook: Settings → Business Integrations → Remove Wouchh
Revoking access immediately prevents Wouchh from taking further actions on your accounts. Cached data associated with your account is deleted within 30 days. See our Data Deletion page for full details.
6. Platform-Specific Rules
The Service respects all platform-imposed restrictions. By using the Service, you acknowledge and agree to the following platform-specific rules:
6.1 TikTok Messaging Restrictions
- You may only reply to users who have messaged your business account first. Initiating unsolicited DMs is strictly prohibited.
- Within 48 hours of a user's first message: your business may send up to 10 messages.
- Active conversation (user has replied): unlimited messages for 48 hours after the user's last reply.
- Inactive conversation (user has not replied for 48+ hours): a maximum of 3 messages until the user responds again.
- Direct message features are not available for users in the European Economic Area (EEA), Switzerland, and the United Kingdom due to TikTok's regional privacy restrictions.
6.2 General Platform Rules
- Content posting is subject to each platform's moderation and approval processes.
- API rate limits imposed by each platform are respected automatically by the Service.
- Comment management (reply, hide, delete) is only available on content you own.
- Published content from unaudited apps may be restricted to private visibility until the app passes platform review.
7. Intellectual Property
7.1 Our Property
The Service, including its design, code, features, documentation, and branding, is owned by Wouchh and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
7.2 Your Content
You retain all rights to content you create and publish through the Service. By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of delivering the features you use (e.g., publishing a post to TikTok on your behalf). This license terminates when you disconnect your account or delete your data.
7.3 Platform Content
Content retrieved from social media platforms (comments, messages, metrics) is governed by each platform's terms. You must not use data obtained through the Service in ways that violate those platform terms.
8. Availability and Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee uninterrupted, error-free, or secure operation of the Service.
- Social media platforms may deprecate, modify, or restrict APIs we rely on at any time. We will make best-effort migrations but cannot guarantee continuity of specific features.
- Platform outages, API changes, or policy updates may temporarily or permanently affect Service functionality.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Wouchh and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:
- Your use of or inability to use the Service
- Lost posts, missed messages, or failed content publishing
- Account actions taken by social media platforms (suspensions, restrictions, content removal)
- API downtime, rate limiting, or data access changes by platform providers
- Unauthorized access to your accounts resulting from your failure to protect credentials
- Any third-party conduct or content accessed through the Service
Our total aggregate liability for all claims arising from the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Wouchh from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your violation of these Terms or any applicable law
- Your violation of platform terms or community guidelines
- Content you publish or messages you send through the Service
- Your unauthorized use of another party's account or data
11. Termination
By you: You may stop using the Service at any time by disconnecting your platforms from the Settings page and logging out. You may also request full data deletion via our Data Deletion page.
By us: We may suspend or terminate your access if you violate these Terms, platform policies, or applicable law. We may also terminate the Service entirely with 30 days' prior notice. Upon termination, your stored data will be deleted within 30 days.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Maharashtra, India, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Nashik, Maharashtra, India, and you consent to the exclusive jurisdiction of those courts.
Before initiating formal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.
13. Modifications
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify you via the Service dashboard or email at least 15 days before the changes take effect
Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and disconnect your accounts.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
15. Entire Agreement
These Terms, together with our Privacy Policy and Data Deletion Policy, constitute the entire agreement between you and Wouchh regarding the Service and supersede any prior agreements or understandings.
